1. About these Terms

1.1 These terms of use (the “Terms”) explain how you may access and use this website (the “Site”). References to the Site include https://www.wiggli.io, https://www.wiggli.io/nl and https://www.wiggli.io/fr and all associated web pages, sub-domains and content operated by us.

1.2 You should read these Terms carefully before using the Site. By accessing or using the Site, or otherwise indicating your consent, you agree to be bound by these Terms and the documents referred to in them. If you do not agree with any of these Terms, you should stop using the Site.

1.3 These Terms govern your use of our public-facing website only. Your access to and use of the Wiggli platform, software, application and related services (the “Product”) is governed by a separate agreement, including our Terms of Service, Acceptable Use Policy, AI & Data Terms, Fair Use & AI Credits Policy, Data Processing Agreement, Service Level Policy and Security Policy. Nothing on the Site forms part of, varies or supersedes those agreements.

2. Who we are

2.1 In these Terms, “we”, “us” and “our” mean WIGGLI SA, a company registered in Belgium under enterprise number BE0678.483.029, with its registered office at 2 Boulevard de la Woluwe, 1150 Brussels, Belgium (and references to our group companies from time to time). “You” and “your” mean the person accessing or using the Site or its Content.

2.2 “Content” means any text, images, video, audio or other multimedia content, software, data or other information or material published on or submitted to the Site.

3. Using the Site

3.1 The Site is provided for your general information and to tell you about us and the Product. It is intended for business and professional users and is not directed at children.

3.2 You agree that you are solely responsible for all costs and expenses you incur in connection with your use of the Site, and, where applicable, for keeping any password, account or log-in details confidential.

3.3 The Site is operated from Belgium. We make no representation that the Site or its Content is appropriate or available for use in any particular location, and the Site is not directed at any jurisdiction where doing so would be unlawful or would subject us to any registration or licensing requirement. If you choose to access the Site from any location, you do so on your own initiative and are responsible for compliance with local laws to the extent they apply.

3.4 We may prevent or suspend your access to the Site if you do not comply with any part of these Terms, any terms or policies to which they refer, or any applicable law.

3.5 As a condition of your use of the Site, you agree not to:

(a) use the Site for any purpose that is unlawful or fraudulent, or otherwise prohibited by these Terms;

(b) distribute viruses, malware or other harmful code, or send spam or unsolicited advertising;

(c) impersonate any person or entity, or simulate communications to collect identity information, authentication credentials or other information (“phishing”);

(d) disrupt or interfere with the Site, our professional activities or any other party’s website or business, harm minors, or promote any unlawful activity;

(e) represent or suggest that we endorse any business, product or service unless we have separately agreed to do so in writing; or

(f) gain or attempt to gain unauthorised access to any computers, data, systems, accounts or networks, or attempt to circumvent any password or user-authentication measures.

4. Your privacy and personal data

4.1 Your privacy and personal data are important to us. Any personal data that you provide to us, or that we collect through the Site, will be handled in accordance with our Privacy Policy and Cookie Policy, which explain what personal data we collect, how and why we collect, store, use and share it, the legal bases on which we rely, your rights under the EU General Data Protection Regulation (GDPR) and the UK GDPR, and how to contact us or a supervisory authority.

4.2 The Site uses cookies and similar technologies. Where required by law, we will obtain your consent before setting non-essential cookies. Please see our Cookie Policy for further details.

5. Ownership, use and intellectual property rights

5.1 The Site and all intellectual property rights in it, including all Content, are owned by us, our licensors or both. “Intellectual property rights” means copyright, trade marks, domain names, design rights, database rights, patents, know-how and all other intellectual property rights of any kind, whether registered or unregistered, anywhere in the world. We and our licensors reserve all such rights.

5.2 Nothing in these Terms grants you any rights in the Site other than as necessary to enable you to access and view it for your own internal, non-commercial reference. You may print or download extracts of Content for that purpose only, provided you do not modify it and you retain all proprietary notices. You agree not to circumvent, disable or delete any notices (including intellectual property notices) or any digital rights or security technology contained within the Site.

5.3 Trade marks. “WIGGLI”, “Wiggli” and the Wiggli logo are trade marks of the relevant rights holders. These include, but are not limited to: our logo, an EU trade mark registered at the EUIPO under number 018363532; WIGGLI, a registered trade mark in the UK under number UK00003610770; Wiggli, an EU trade mark registered at the EUIPO under number 018338892; and Wigglers, an EU trade mark registered at the EUIPO under number 018345048. 

5.4 Other trade marks, trade names or company names may also appear on the Site. Use of any trade mark displayed on the Site is strictly prohibited unless you have our prior written permission or that of the relevant rights holder.

6. Submitting information to the Site

6.1 While we try to keep the Site secure, we cannot guarantee the security of any information you transmit to us and cannot guarantee that it will be kept confidential. You should not send us any patentable ideas, patent applications, advertising or marketing suggestions, prototypes or other information that you regard as confidential, commercially sensitive or valuable (“Unwanted Submissions”).

6.2 We may use any Unwanted Submission as we see reasonably fit on a free-of-charge basis. We do not monitor the Site for such submissions and will not be legally responsible for keeping any Unwanted Submission confidential, nor liable to you or anyone else for any use of it.

7. Accuracy of information and availability of the Site

7.1 While we try to make sure that the Site is accurate, up-to-date and free from bugs, we cannot promise that it will be, or that it will be fit or suitable for any purpose. Any reliance you place on the Content is at your own risk.

7.2 Content is provided for general information only and to tell you about us, the Product and related news and features. It does not constitute technical, financial, legal, recruitment or other professional advice and should not be relied on for any decision.

7.3 Any AI-generated or AI-assisted content that may appear on the Site is provided for illustration and general information only, may be inaccurate or incomplete, and must not be relied upon. Descriptions of the Product’s AI features on the Site are indicative only and are subject to the separate agreement governing the Product.

7.4 We may suspend, withdraw or restrict the availability of all or any part of the Site at any time and for any reason. We do not promise that the Site, or any Content on it, will always be available or uninterrupted.

8. Accessibility

8.1 We aim to make the Site accessible and usable for as many people as reasonably possible. If you experience any difficulty accessing the Site, please contact us at support@wiggli.io.

9. Hyperlinks and third-party sites

9.1 The Site may contain hyperlinks or references to third-party websites. These are provided for your convenience only. We have no control over, and accept no responsibility for, the content, products or services of any third-party website. The inclusion of a hyperlink does not imply our endorsement of the linked site. Your use of a third-party site is governed by that site’s own terms.

9.2 We do not object to third-party websites linking to our Site, provided that: (a) our pages load into the user’s entire window and not into frames; (b) notwithstanding clause 5 above, our logo and other intellectual property remain ours and may not be used without our permission; (c) the link is not used in a misleading or defamatory context or in a way that suggests any association with, or endorsement by, us where none exists; (d) you use clear linking wording (avoiding vague terms such as “click here”); and (e) the linking entity is not an automated bot, scraper, or crawler, for which prior written authorization is required. Prior notice of any link would be appreciated but is not mandatory.

9.3 We reserve the right to withdraw permission to link to our Site at any time, in which case you must remove all links promptly on request.

10. Our liability

10.1 Except for any legal responsibility that we cannot exclude in law (such as for death or personal injury), our liability is fully excluded for any loss, damage or harm suffered by you or by any user which may occur from the Site, use of the Site and/or its Content or any breach of these Terms or our Privacy and Cookie Policy. This exclusion of liability extends to any direct, indirect, material, immaterial, financial, reputational or IT-related losses, unless such losses cannot be excluded or limited by applicable law.

10.2 The Site is made available free of charge and on an “as is” and “as available” basis. To the maximum extent permitted by law, we exclude all conditions, warranties, representations or other terms that may apply to the Site or any Content, whether express or implied.

11. Events beyond our control

11.1 We are not liable for any failure or delay in performing our obligations under these Terms caused by any event or circumstance beyond our reasonable control, including strikes or industrial disputes, failure of utilities or communications networks, breakdown of systems, denial-of-service or other attacks, or acts of God, fire, flood, epidemic, pandemic or governmental action.

12. General

12.1 Variation. These Terms may be varied by us from time to time. The current version will always be displayed on the Site with the date it was last updated. By continuing to use the Site after any change, you agree to be bound by the updated Terms. It is your responsibility to check these Terms periodically.

12.2 Assignment. We may transfer our rights and obligations under these Terms to another organisation. You may not transfer any of your rights or obligations without our prior written consent.

12.3 Severability. If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be deemed modified to the minimum extent necessary or, if that is not possible, severed, and the remaining provisions will continue in full force and effect.

12.4 No waiver. Any failure or delay by us in enforcing any provision of these Terms will not be a waiver of that or any other provision.

12.5 Third-party rights. No one other than a party to these Terms has any right to enforce any of them.

12.6 Entire agreement. These Terms, together with the documents referred to in them, constitute the entire agreement between you and us regarding your use of the Site.

13. Governing law and jurisdiction

13.1 These Terms, and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes or claims), are governed by and construed in accordance with Belgian law.

13.2 The courts of Brussels, Belgium have exclusive jurisdiction to settle any such dispute or claim, save that this does not deprive a consumer of the protection of any mandatory law applicable in their country of residence.
